Read Memo» Tort Immunity Applies to Municipality Without Exceptions for Willful and Wanton Conduct The Illinois Appellate Court for the First District reversed the circuit court, dismissed the claims against the City of Vandalia as a municipal defendant and remanded the case for determination of whether it acted as a railroad. The case arose out of a fatal train collision with a vehicle during the annual Halloween celebration. On March 9, Governor JB Pritzker issued a state disaster proclamation regarding the spread of COVID-19. In addition to that order, the Governor has issued orders closing schools, limiting public and private gathering sizes and prohibiting on-site consumption of food and beverages at bars and restaurants to prevent the further spread of COVID-19.
